If you have reached retirement age and are divorced, you may be able to collect on your ex-spouse's social security.  Below you will find general information regarding the requirements at the time of this article to help you determine if you are qualified.

If you are divorced but your marriage lasted 10 years or longer, you may qualify to receive social security benefits on your ex-spouse's record.  Your ex-spouse does not need to remain unmarried following your divorce for you to collect.  Below is a list of qualifications to help you determine if you can collect:

-You are unmarried.

-You are age 62 years or older.

-Your benefit you are entitled to that is based on your own work is less than the benefit you would get based on your ex-spouse's work.

-Your ex-spouse is entitled to social security retirement or disability benefits.

-Your full retirement age is 67.  If upon that time you elect to apply for benefits based on your former spouse's record you will receive one-half of his/her full retirement amount or disability benefit.  The benefits don't include any delayed retirement credits your ex may receive.

-Generally, you may not collect if you remarry unless the later marriage ends in divorce, death or legal annulment. 

-Even if your ex has not applied for his/her benefits you may still qualify if your divorce ended 2 years or longer.  Your standard retirement earnings still apply.

-There is no effect on your ex-spouse's benefits or his/her spouse's benefits if you choose to receive benefits based on your former spouse's record.

For those who were born prior to January 2, 1954, and have reached full retirement age (67), you may elect to receive only your divorced spouse's benefit and delay your benefits.  If you were born after that date, you will not have the option to take only one benefit at full retirement age.  If you file for one benefit, you will be filing for all retirement or spousal benefits.
